De conformidad con los artículos 5.2 y 5.6 del Acuerdo relativo a la Aplicación del Artículo VI del Acuerdo General sobre Aranceles Aduaneros y Comercio de 1994, en adelante Acuerdo Antidumping, una autoridad investigadora podrá iniciar una investigación sin haber recibido una solicitud escrita hecha por la rama de producción nacional o en nombre de ella, cuando tenga pruebas suficientes del dumping, del daño y de la relación causal.

Como primer hallazgo sobre la existencia de una posible práctica desleal relacionada con importaciones de calzado originarias de la República Popular China, en adelante China, la Secretaría de Economía tuvo conocimiento por diversos artículos sobre un aumento considerable en las importaciones de calzado provenientes de Asia.

Producto objeto de investigación

I. Botas con corte sintético y suela sintética;

II. Sandalias básicas, formales y de vestir con corte sintético y suela sintética;

III. Tenis choclo deportivo con corte sintético y suela sintética;

IV. Tenis choclo deportivo con corte textil y suela sintética;

V. Calzado casual con corte textil y suela sintética, y vi)

VI. Sandalias básicas, formales y de vestir, con corte textil y suela sintética.

Características

Calzado con las siguientes características: con suela y parte superior de caucho (hule vulcanizado) o plástico; y con suela de caucho (hule vulcanizado), plástico, cuero natural o regenerado y parte superior de materia textil.

Las botas se distinguen porque cubren el tobillo y no cuentan con puntera metálica de protección, aunque podrían llevar puntera de protección diferente a la metálica. Las sandalias consisten de un piso o suela desde donde salen tiras, correas o cintas, las cuales sujetan el pie y/o pierna. Los tenis choclo deportivo son reconocibles como diseñados para la práctica de tenis, baloncesto, gimnasia, entrenamiento, caminata, ejercicio y demás actividades físicas similares.

Los diseños del calzado pueden ser variados, entre otros, clásicos, de moda o modernos, y uso cotidiano. El material del forro puede ser cuero, textil, tejido o no tejido, sintético o sin forro. Las medidas o tallas de los productos de calzado son variadas y dependerán del género al cual se destinen para su uso, ya sea hombres, mujeres, niños, niñas o infantes.

RESOLUCIÓN

Se declara el inicio de oficio de la investigación antidumping sobre las importaciones de calzado originarias de China, independientemente del país de procedencia, que ingresan a través de las fracciones arancelarias 6402.91.06, 6402.99.19, 6402.99.20, 6404.11.17, 6404.19.02, 6404.19.08, y 6404.19.99 de la TIGIE, o por cualquier otra.

Cualquier persona que acredite tener interés jurídico en el resultado del procedimiento, contarán con un plazo de veintitrés días hábiles para acreditar su interés jurídico y presentar los argumentos y las pruebas que consideren convenientes.

La Resolución entrará en vigor al día siguiente de su publicación en el DOF.

Ex officio initiation of the antidumping investigation

Pursuant to articles 5.2 and 5.6 of the Agreement on Implementation of Article VI of the General Agreement on Tariffs and Trade 1994, hereinafter Antidumping Agreement, an investigating authority may initiate an investigation without having received a written request made by or on behalf of the domestic industry, when it has sufficient evidence of dumping, injury and causal link.

As a first finding of the existence of a possible unfair practice related to imports of footwear from the People’s Republic of China, hereinafter referred to as China, the Ministry of Economy learned from various articles about a considerable increase in imports of footwear from Asia.

Product under investigation

I. Boots with synthetic cut and synthetic sole;

II. Basic, formal and dress sandals with synthetic upper and synthetic sole;

III. Choclo sports tennis shoes with synthetic cut and synthetic sole;

IV. Choclo sports tennis shoes with textile upper and synthetic sole;

V. Casual footwear with textile upper and synthetic sole, and vi).

VI. Basic, formal and dress sandals, with textile upper and synthetic sole.

Characteristics

Footwear with the following characteristics: with sole and upper of rubber (vulcanized rubber) or plastic; and with sole of rubber (vulcanized rubber), plastic, natural or regenerated leather and textile upper.

Boots are distinguished because they cover the ankle and do not have a protective metal toe cap, although they may have a protective toe cap other than metal. Sandals consist of a sole or sole from which straps, straps or tapes emerge, which hold the foot and/or leg. Choclo sport tennis shoes are recognizable as being designed for tennis, basketball, gymnastics, training, walking, exercise and other similar physical activities.

The designs of the footwear may be varied, including classic, fashionable or modern, and for everyday use. The lining material may be leather, textile, woven or non-woven, synthetic or unlined. The measurements or sizes of footwear products are varied and will depend on the gender to which they are intended for use, whether men, women, boys, girls or infants.

 RESOLUTION

It is declared the initiation of the antidumping investigation on the imports of footwear from China, independently of the country of origin, that enter through the tariff fractions 6402.91.06, 6402.99.19, 6402.99.20, 6404.11.17, 6404.19.02, 6404.19.08, and 6404.19.99 of the Tariff of the General Import and Export Tax Law, or through any other.

Any person that proves to have a legal interest in the result of the procedure, shall have a term of twenty-three working days to prove their legal interest and present the arguments and evidence that they deem convenient.

The Resolution will become effective the day after its publication in the Official Gazette of the Federation.
